Disclaimer & Warranty Policy for Voltura Bikes

1. Introduction

Voltura Bikes (“we,” “us,” “our”) is a retailer and authorized dealer of Eunorau electric bicycles (“Eunorau Ebikes,” “Products”). When you purchase a Eunorau ebike through us, your purchase is subject to both Voltura’s terms and Eunorau’s warranty policy. This Disclaimer & Warranty Policy describes Voltura Bikes’ roles, limitations of liability, and the warranty process through Eunorau.


2. Dealer Role & Warranty Claims

  • Voltura Bikes acts solely as an authorized dealer of Eunorau ebikes. We do not manufacture the Products, set the warranty terms, or handle warranty servicing directly, except as authorized by Eunorau.

  • All warranty claims, including for defects, manufacturing problems, or failures covered under warranty, must go through Eunorau.

  • Voltura Bikes will assist in facilitating contact with Eunorau, but final decisions, replacements, repairs, or denials are under Eunorau’s discretion per their published warranty policy.


3. Warranty Coverage (via Eunorau)

Below is a summary of Eunorau’s current warranty policy. For full details you should refer to Eunorau’s site and warranty documentation.

a. Warranty Term

  • Eunorau offers a Limited Warranty beginning August 1, 2023 for products bought in the U.S. or Canada. (EUNORAU E-BIKE US)

  • The warranty requires product registration soon after purchase. (EUNORAU E-BIKE US)

b. What Is Covered

  • Frames: 10-year limited warranty (replacement or repair) for original purchaser. (EUNORAU E-BIKE US)

  • Battery, motor, electrical components: 24-month limited warranty for original parts. (EUNORAU E-BIKE US)

c. What Is Not Covered (Exclusions)

Eunorau’s warranty does not cover (among other exclusions): (EUNORAU E-BIKE US)

  • Ordinary wear and tear (brake pads, tires, rotors, grips, spokes, chains, etc.) (EUNORAU E-BIKE US)

  • Labor charges for part replacement or changeover. (EUNORAU E-BIKE US)

  • Damage due to accidents, abuse, misuse, improper storage, exposure to moisture/heat/elements, or other improper maintenance. (EUNORAU E-BIKE US)

  • Cosmetic damage (scratches, dents, paint fade) not resulting from defects. (EUNORAU E-BIKE US)

  • Use of non-approved accessories, or battery chargers not compatible or incorrectly used. (EUNORAU E-BIKE US)

  • Damage to serial numbers or barcodes; if removed or altered. (EUNORAU E-BIKE US)

d. Shipping Damage

  • Eunorau’s warranty does not cover damage that occurs during shipping. (EUNORAU E-BIKE US)

  • If you receive a Product that is damaged in transit, you must:

    1. Be present and sign off on the package during delivery (or note damage at time of delivery).

    2. Immediately notify Eunorau with photographic/video evidence of damage and damaged parts.

    3. Keep all original packaging and do not use the product until Eunorau’s after-sale team provides instructions. (EUNORAU E-BIKE US)


4. Limitations of Liability

  • Eunorau’s warranty is the exclusive remedy for defects or failures covered under the warranty. “Implied warranties” (for example warranty of merchantability or fitness for a particular purpose) are limited to the duration of the express warranty. (EUNORAU E-BIKE US)

  • Eunorau will not be liable for incidental, consequential, punitive, or special damages, or loss of data, time, use, profits, reputation, or other economic loss arising from use or inability to use the Product, even if Eunorau was aware such damages could occur. (EUNORAU E-BIKE US)

  • Some jurisdictions do not allow limitation of implied warranties or exclusion of certain damages; where required by law, those limitations or exclusions may not apply to you. (EUNORAU E-BIKE US)


5. Dispute Resolution & Arbitration

  • Any dispute with Eunorau arising from or related to Eunorau’s warranty or the sale, value, condition, or performance of the Products must be resolved exclusively via final and binding arbitration, except for claims that can be brought in small claims court. (EUNORAU E-BIKE US)

  • No class actions or collective proceedings are allowed under this arbitration agreement. (EUNORAU E-BIKE US)

  • The arbitration will follow rules from the American Arbitration Association (or other consumer arbitration rules if AAA rules do not apply) and be governed by applicable laws (e.g. of Nevada). (EUNORAU E-BIKE US)

  • Original purchaser may opt out of arbitration by sending notice via email within 30 calendar days of purchase (including certain details such as purchaser’s name, address, date of purchase, product model, serial number). (EUNORAU E-BIKE US)


6. Voltura Bikes’ Disclaimer & Limitations

As an authorized dealer, Voltura Bikes offers the following disclaimers and limitations:

  • Manufacturer Defects / Warranty Claims
    We are not responsible for defects in materials or workmanship of the Products. If you believe your ebike has a manufacturing defect, you must submit the claim to Eunorau under their warranty policy.

  • Shipping Damage
    Voltura Bikes is not liable for damage that occurs during shipping. You should inspect the package upon delivery. If you notice shipping damage, follow the steps under Eunorau’s shipping damage policy (see section 3.d above).

  • Alterations, Misuse, Non-authorized Repair
    We are not responsible for any damage or issues caused by unauthorized modifications, installing non-approved accessories, improper maintenance, misuse, or other actions contrary to the Product manual or manufacturer’s instructions.

  • No Additional Warranties
    Voltura Bikes does not offer warranties beyond those offered by Eunorau, unless explicitly stated in writing. Any statements (oral or written) not included in Eunorau’s warranty documentation are not binding unless confirmed by Eunorau.


7. Your Responsibilities

  • Register your Product with Eunorau promptly after purchase to ensure eligible warranty service.

  • Keep proof of purchase (receipt or other documentation showing date, Product model, serial number).

  • Perform routine maintenance as per manufacturer’s guidelines.

  • Keep original packaging in case needed for shipping claims.

  • Use only chargers, batteries, parts, and accessories approved by Eunorau.


8. Governing Law

  • Unless otherwise required by your jurisdiction, the laws of the State of Nevada (or as per Eunorau’s policies) shall govern all warranty and limitation of liability matters.

  • If any part of this Disclaimer & Warranty Policy is held invalid or unenforceable, that part shall be severed, and the remainder shall continue in full force and effect.
